This website and the geolocation service known as Geofindy (hereinafter, the “Service”) are available to any user, subject to the following terms and conditions: these Terms of Use and Contracting (hereinafter, “ToU”), along with our Privacy Policy and Cookies Policy.
By using the Service, you accept these ToU and agree not to use the website or the Service for any illegal purposes.

The Service allows for the geolocation of devices by sending an SMS to request the explicit consent of the recipient. Only if the recipient expressly accepts, their real-time geographic location will be shared with the requester.
The Service does not guarantee the effective location of the targeted person in cases such as:

• The device is turned off, out of coverage, or stolen.
• The recipient does not accept the link sent.
The Service solely provides the technical means necessary for location sharing.

This website may contain links to third-party pages. Geofindy does not control such sites and is not responsible for their content, quality, truthfulness, or accuracy. Access to these sites is subject to their own terms and conditions.

The user declares that they are of legal age according to the laws of their country of residence and have the legal capacity to accept this agreement. The user also guarantees that the information provided to access the Service is true, complete, and accurate.

The content of the website and the Service (including texts, graphics, images, software, and code) is the property of Geofindy or third parties authorized for its use. Reproduction, modification, distribution, or exploitation of this content is prohibited without prior written authorization.

You may contribute to the Service by submitting messages or inquiries. By doing so, you grant Geofindy a worldwide, non-exclusive, royalty-free license to use, reproduce, and modify such content for legitimate purposes. However, the company reserves the right to remove any illegal or inappropriate content.

The prices of the Service are listed in U.S. dollars (USD) and may be subject to taxes according to the applicable tax laws in the user's jurisdiction. Prices are subject to change without prior notice.

Payment may be made using credit or debit cards (Visa, MasterCard, etc.). All transactions are securely processed using SSL technology through Stripe, our payment provider. Your payment information is handled directly by Stripe and is never stored on our servers.

Under no circumstances shall Geofindy, its suppliers, or licensors be held liable for:
(i) Special, incidental, or consequential damages; (ii) The costs of procuring substitute products or services; (iii) Interruption of use, or loss or corruption of data; (iv) Any amount exceeding the fees paid by you to Geofindy under this Agreement during the twelve (12) months preceding the cause of action. This limitation of liability applies to the maximum extent permitted by law, both in the United States and in other jurisdictions where we operate.

By using the Portal, you represent and warrant that:
(i) Your use of the Portal will be in strict accordance with this Agreement, our Privacy Policy, and all applicable laws, regulations, and rules, including, but not limited to, local, state, and national laws regarding online conduct and acceptable content; (ii) Your use of the Portal will not infringe or misappropriate the intellectual property rights of any third party.

Geofindy implements advanced technical measures to ensure the security of the Service. However, it cannot guarantee complete invulnerability against potential failures or attacks.

Geofindy offers the following plans:

• Trial Period: A 24-hour trial for $0.50 USD.
• Monthly Subscription: After the trial period ends, the subscription will automatically renew at a cost of $39.99 USD per month.

The subscription will automatically renew unless you cancel it at least 24 hours before the end of the trial or the active subscription period. By registering, you authorize Geofindy to charge recurring fees using the payment method provided.

Payments are non-refundable, except in the following cases:

• A confirmed technical failure that prevents use of the service.
• A refund is required under applicable law.
To request a refund, you can contact us at [email protected]. Refund requests must be made within the first 30 days following the initial charge. Geofindy reserves the right to evaluate each refund request on a case-by-case basis.

Geofindy may modify these terms and conditions by notifying users through the website or via email. Any provisions deemed null or unenforceable will not affect the validity of the remaining parts of the agreement.

You agree to indemnify and hold harmless Geofindy, its contractors, licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Portal, including but not limited to: (i) Any breach of this Agreement; (ii) Any user-generated content or actions that infringe the rights of third parties or cause harm to others.

Unless otherwise required by applicable law, this Agreement, access to the Portal, and its use shall be governed by the laws of the United States, excluding its conflict of law provisions.

Any dispute arising from this Agreement shall be resolved exclusively through binding arbitration, in accordance with the applicable rules. The arbitration shall take place in the United States, in English, and its decision shall be binding and enforceable in any competent court. However, claims related to intellectual property rights or injunctive relief may be brought directly before any competent court.

If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be interpreted to reflect the original intent of the parties, and the remaining provisions shall remain in full force and effect.

The failure of either party to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision, nor shall it affect its validity or enforceability.

You may assign your rights under this Agreement to any party that agrees to be bound by its terms and conditions. Geofindy may assign its rights under this Agreement without restriction. This Agreement shall be binding upon the parties, their successors, and authorized assigns.
